Terms of service

Welcome to Grafia!

These terms (the "Terms") govern your use of the mobile application Grafia, developed and operated by Shanghai Yingsu Technology Co., Ltd. By downloading, accessing, or using the App, you agree to be bound by these Terms.

1. Account Registration and Security

  • Login Method: You must use "Sign in with Apple" to create an account. You agree to provide accurate, current, and complete profile information (Avatar, ID Name, Nickname).
  • Responsibility: You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

2. User Conduct

You agree not to use Grafia to:

  • Upload, store, or share any photos that infringe upon any third party's copyright, trademark, privacy, or other intellectual property rights;
  • Upload any content that is unlawful, obscene, defamatory, threatening, harassing, hateful, or racially or ethnically offensive;
  • Upload any material containing viruses or malicious code designed to interrupt, destroy, or limit the functionality of any software;
  • Collect or store personal data about other users without their consent;
  • Engage in any unauthorized commercial activities using the App.

3. User Content and Intellectual Property

  • Ownership: You retain all ownership rights to the photos you upload. We do not claim any ownership over your photos.
  • License Grant: To enable sharing via shared albums, you grant us a worldwide, non-exclusive, royalty-free license to host, store, and use your photos solely for the purpose of operating and providing the Grafia service. This license continues only while you use the service and ends when you delete your photos or terminate your account.
  • Feedback: If you provide us with any feedback or suggestions, we may use them without any obligation to you.

4. Our Intellectual Property

The Grafia app itself (including but not limited to code, design, trademarks, and text) is owned by Shanghai Yingsu Technology Co., Ltd. and is protected by copyright, trademark, and other laws. You may not copy, modify, or distribute any part of the App without our express written consent.

5. Third-Party Services

Our service uses Cloudflare for photo storage. Your use of third-party services may be subject to their respective terms.

6. Termination

We reserve the right to suspend or terminate your account or access to the App at any time for any reason (including, without limitation, for breach of these Terms), without notice.

7. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, or error-free.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Shanghai Yingsu Technology Co., Ltd. and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of or inability to use the service.

9. Governing Law

These Terms shall be governed by the laws of the People's Republic of China, excluding its conflict of laws provisions. For users in Europe and the US, nothing in these Terms affects your non-waivable statutory rights as a consumer under the laws of your country of residence.

10. Changes to Terms

We may revise these Terms from time to time. Any material changes will be notified to you within the App. Your continued use of the App after the changes become effective constitutes your acceptance of the new Terms.
